Abstract. Regardless of a citizen’s property status, everyone thinks about the future fate of his or her property. That is the reason why, out of the 2 grounds of inheritance, according to the law and according to the will, the legislator gives the citizen the first opportunity to decide the future fate of the property owned by him at his own discretion. Moreover, this is possible only by making a will. The foundations of inheritance both originated from ancient times, evolved in parallel and were applied as needed. Those forms of inheritance are discussed, clarifying some often-misunderstood issues.
